Girafe Terms of Use

1. Purpose
These Terms of Use (“Terms”) define the conditions for accessing and using the Girafe platform, available at www.girafe.co.
Girafe is a web platform for making actors, profiles and projects visible, mapping them, and facilitating connections within a territory. It allows users, in particular, to create a profile, present an intention, needs, offers and projects, and facilitate connections mediated by the Girafe team.
The use of certain features of the platform, in particular account creation, requires acceptance of these Terms and of the Privacy Policy. During registration, this acceptance is collected through an unchecked box. Registration cannot be completed without this acceptance.

Girafe Planet is a French non-profit association under the law of 1901, linked to the Girafe project. It may carry or support certain community-based, cultural, territorial or public-interest activities related to Girafe.
Girafe Planet is a separate structure from Girafe France SAS. Its relationship with the Girafe project is mentioned for the sake of transparency. Any involvement by Girafe Planet in certain projects, events or public-interest activities does not mean that it is responsible for the entire digital platform, unless otherwise stated in the context of a specific initiative.

4. Definitions
In these Terms:
- “Platform” means the Girafe website and the services offered on it.
- “User” means any person who visits or uses the platform.
- “Member” means a user who has created an account.
- “Profile” means a personal profile created by a member.
- “Project” means a page describing an initiative, a need, an offer, a search for collaboration or a project.
- “Page” means either a profile or a project published on the map.
- “Contact request” means a message sent from a page in order to request a connection.
- “Girafe team” means the persons authorized to administer, moderate, publish, reject or relay content and contact requests.
5. Description of the service
The platform allows users, in particular:
- to consult a public map displaying profiles and projects;
- to create a profile with the help of a conversational assistant using artificial intelligence technology;
- to create or modify projects linked to an account;
- to publish, after validation by the Girafe team, a publicly visible page;
- to present needs, offers, intentions, resources, projects, categories and approximate or geolocated locations;
- to allow a visitor to send a contact request about a page, without the recipient member’s email address being made public;
- to consult editorial or media content, including in the media library;
- to subscribe, where applicable, to communications or newsletters related to Girafe.
The platform does not guarantee that a collaboration, partnership, funding, support relationship or connection will actually be concluded. Girafe facilitates identification, visibility and contact, but does not replace the decisions, responsibilities or commitments of users, partners, associations, institutions or public authorities concerned.
6. Access conditions and age requirement
Certain pages of the platform may be consulted freely.
Account creation and the publication of a page are reserved for adults. Minors are not authorized to create an account or publish a page on the platform.
Where projects or initiatives concern minors or vulnerable groups, users must ensure that no nominative or identifying information about them is published. Such situations must be presented in general and non-individualized terms, unless a specific, authorized and clearly defined framework applies.
7. Account creation
An account is created using an email address, without a password chosen by the user. Login is based on a magic link sent by email.
During registration, the user may be asked to provide, in particular, their first name, email address, occupation, location, and information relating to their needs, offers and intentions.
The user undertakes to provide accurate, current and non-misleading information. The user may modify certain information from their account area, within the limits of the available features.
Girafe reserves the right to reject, suspend or delete an account or page in the event of use contrary to these Terms, the law, the rights of third parties or the spirit of the platform.
8. Conversational assistant and artificial intelligence
Girafe provides a conversational assistant intended to help the user formulate their profile, needs, offers, intention or certain sections of their page.
This assistant relies on artificial intelligence technology provided by OpenAI. Before the conversation begins, an information screen informs the user that AI is being used.
The user acknowledges that the responses or summaries generated by the assistant may contain approximations, errors or imperfect wording. It is the user’s responsibility to reread, correct and validate the information that will be used to create their profile or project.
The user undertakes not to communicate to the assistant any unlawful, confidential, excessively sensitive information, or information concerning third parties without a legitimate basis. Users are specifically asked not to enter nominative information relating to minors or to sensitive medical, social, family, school-related or administrative situations.
9. Location and map
The platform uses a geocoding and mapping service in order to position pages on a map. The address entered by the user may be transmitted to a mapping provider in order to suggest addresses and determine geographic coordinates.
An information notice is displayed before geocoding. The complete address entered is not displayed publicly in clear text. However, the public page may include a shortened location as well as a geographic point on the map.
The user acknowledges that the publication of a point on the map may reveal a more precise location than the public text version of the address. It is the user’s responsibility not to enter a location that they do not wish to be publicly associated with their page.
10. Publication of pages and public visibility
Pages created on the platform may be moderated before publication. The Girafe team may validate, reject, unpublish or request a correction to a page.
When a page is published, certain information becomes public, including, depending on the case: title, first name, occupation, summary, needs, offers, intention, category, image, media, public location, map point, project, partners, sponsors or other descriptive fields.
The user is informed that content published on a page may be viewed by visitors who are not logged in. The user undertakes to publish only information that they agree to make publicly visible.
Private information, such as the member’s email address, complete address and certain account data, is not displayed publicly.
11. Contact requests
Contactability is optional. During registration or from their settings, the member may authorize or disable the display of the “Contact” button on their page. This option is unchecked by default and is not required in order to create an account.
When a visitor sends a contact request from a page, their email address and message are transmitted to the Girafe team. The recipient member’s email address is not made public. Girafe acts as an intermediary and may decide whether or not to transmit the request.
Girafe does not guarantee that any contact request will be transmitted, accepted or followed by a response. The Girafe team may refuse to relay a request that is manifestly inappropriate, abusive, commercial, fraudulent, discriminatory, unlawful or contrary to the purpose of the platform.
12. Newsletter and communications
The platform may offer subscription to a newsletter or to communications relating to Girafe, its news, projects, calls for contribution or events.
Subscription to these communications is optional. Emails may be sent through a specialized provider, in particular Brevo.
The user may unsubscribe at any time using the unsubscribe link included in the emails received or through the settings available on the platform.
13. Prohibited conduct
The user undertakes, in particular, not to:
- publish unlawful, defamatory, insulting, discriminatory, violent, hateful, misleading content or content infringing the rights of third parties;
- impersonate any person or organization;
- publish personal information concerning a third party without authorization or a legitimate basis;
- publish sensitive or nominative information concerning minors;
- use the platform for abusive solicitation, spam, fraud or unauthorized data collection;
- harm the security, operation or technical integrity of the platform;
- attempt to access data or areas to which they are not authorized to have access.
14. Moderation
Girafe may moderate pages, projects, contact requests, media or content published or submitted on the platform.
Moderation may lead to a request for correction, refusal of publication, unpublication, suspension of an account or deletion of an account, in particular in the event of a breach of these Terms or a risk to persons, third parties, institutions or the platform.
Girafe is not required to provide a detailed justification for each moderation decision, but may provide a general explanation where appropriate.
15. Intellectual property
The content of the site, including texts, images, logos, videos, graphics, structure and design, is protected by intellectual property law. It is the property of Girafe France SAS, Girafe Planet or their contributors and partners, unless otherwise stated.
Any unauthorized reproduction, representation, modification or distribution, in whole or in part, is prohibited.
The user retains the rights they hold over the content they submit or publish on the platform. By submitting content to Girafe, the user authorizes Girafe, on a non-exclusive and free-of-charge basis, to host, reproduce, display, technically adapt and communicate that content to the public in the context of the operation, moderation, reasonable promotion and visibility of the platform and published pages.
The user guarantees that they hold the necessary rights to the texts, images, videos, links, documents or other elements they transmit. The user undertakes not to publish content that infringes intellectual property rights, image rights, privacy rights or the rights of third parties.
16. Liability
Girafe makes reasonable efforts to ensure the operation, security and availability of the platform. However, the platform may experience interruptions, errors, maintenance operations, changes or temporary limitations.
Girafe may not be held liable for:
- content published or provided by users;
- the consequences of a connection or the absence of a connection;
- commitments made directly between users, associations, public authorities, companies, institutions or partners;
- errors, omissions or inaccuracies in information provided by users;
- indirect damage, loss of opportunity, loss of data or harm resulting from improper use of the platform.
Girafe is not a party to any relationships, agreements, contracts, collaborations or commitments that may arise between users or partners following a connection.
17. Personal data
The processing of personal data carried out in connection with the platform is described in the Privacy Policy, available on the site.
The user is invited to read that policy before using the platform or creating an account.
18. Cookies and trackers
The platform may use cookies necessary for its operation, in particular for login, language and security, as well as trackers subject to consent, in particular for audience measurement if Google Analytics is enabled.
Non-essential trackers are blocked until the user has given consent through the cookie banner. In the event of refusal, they are not loaded.
Embedded videos are loaded on click and use, where possible, a no-cookie mode before activation.

19. Account deletion
A member may request deletion of their account through the features provided. Deletion results in the deletion of the account and the pages linked to it, according to the available technical methods, subject to data that Girafe may be required or authorized to keep for legal, evidentiary, security or third-party contact request management reasons.
Certain data relating to contact requests may concern third parties and is not necessarily deleted solely because the recipient member’s account is deleted.
20. Changes to the Terms
Girafe may modify these Terms in order to take into account changes in the service, applicable law, features or organization of the platform.
In the event of a material change, Girafe may inform users by any appropriate means. Continued use of the platform after the new Terms enter into force constitutes acceptance of them, unless otherwise provided.
21. Applicable law
These Terms are governed by French law.
In the event of any difficulty, the user is invited to contact Girafe at the following address: contact@girafeplanet.com.
Failing an amicable resolution, any dispute will be submitted to the competent courts in accordance with ordinary rules of law.
